ANSWERS TO FREQUENTLY
ASKED QUESTIONS When do I have a right to a jury trial? If
you are charged with a felony and your case is in the Circuit Court or if
you have been charged with a misdemeanor and appealed your conviction to
Circuit Court you have a right to be tried by a jury.
- If my
child is charged with possession of marijuana, will he/she go to
jail? Not likely. In fact, if they have had no other problems with
the law, they may well be eligible for the first offender program and be
eligible to have the charge dismissed after a year of good behavior and
successful completion of the program.
- If I carry a gun in my
pocket instead of on the outside, is it illegal? Yes, unless you
have a concealed weapons permit, any gun or knife that is possessed in a
manner that it cannot be seen is a crime.
- If I forgot my
Court date and didn't go could I be charged for that? Most likely.
Failure to appear for your scheduled Court date is a separate and distinct
offense.
